END USER LICENSE AGREEMENT

This End User License Agreement ("Agreement") is a legal agreement between you ("User" or "you") and EHM Tech LLC ("Company", "we", "us", or "our") for the use of Tips45 (Tip Tracker) mobile application (the "App").

By downloading, installing, or using the App, you agree to be bound by the terms of this Agreement. If you do not agree to these terms, do not use the App.

1. LICENSE GRANT

Subject to your compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on a mobile device that you own or control, solely for your personal, non-commercial use.

2. IMPORTANT FINANCIAL DISCLAIMER

THE APP IS PROVIDED FOR PERSONAL RECORD-KEEPING PURPOSES ONLY. IT IS NOT A SUBSTITUTE FOR PROFESSIONAL FINANCIAL OR TAX ADVICE.

The tip tracking, earnings summaries, and statistics provided by this App:

  • Are for personal record-keeping and informational purposes only
  • Should not be relied upon as the sole source for tax reporting
  • Do not constitute tax, legal, or financial advice
  • May not account for all income reporting requirements in your jurisdiction
  • Are your responsibility to verify for accuracy

Always consult a qualified tax professional or accountant for guidance on reporting tip income and meeting your tax obligations.

3. LICENSE RESTRICTIONS

You agree not to:

  • Copy, modify, or distribute the App
  • Reverse engineer, decompile, or disassemble the App
  • Rent, lease, lend, sell, or sublicense the App
  • Use the App for any unlawful purpose
  • Remove any proprietary notices from the App
  • Use the App to provide payroll or accounting services to others

4. IN-APP PURCHASES

The App offers an optional "Pro" subscription that unlocks additional features. Purchases are processed through the Apple App Store or Google Play Store.

Subscription management is handled by RevenueCat. By purchasing a subscription, you agree to RevenueCat's data collection as described in our Privacy Policy.

Refunds for in-app purchases are subject to the refund policies of Apple or Google, as applicable. We do not directly process payments or issue refunds.

5. PRIVACY

Your use of the App is also governed by our Privacy Policy, available at https://www.ehm-tech.com/tip-tracker/privacy/. By using the App, you consent to the practices described in the Privacy Policy.

6. DISCLAIMER OF WARRANTIES

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR COMPLETENESS OF CALCULATIONS

We do not warrant that the App will be uninterrupted, error-free, or that all data will be preserved in all circumstances.

7. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL EHM TECH LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF OR INABILITY TO USE THE APP, OR ANY FINANCIAL DECISIONS MADE BASED ON APP DATA.

8. INDEMNIFICATION

You agree to indemnify and hold harmless EHM Tech LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of this Agreement.

9. TERMINATION

This Agreement is effective until terminated. We may terminate your license at any time if you fail to comply with any term of this Agreement. Upon termination, you must cease all use of the App and delete all copies.

10. CHANGES TO THIS AGREEMENT

We reserve the right to modify this Agreement at any time. Continued use of the App after changes constitutes acceptance of the modified Agreement.

11. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.
