END USER LICENSE AGREEMENT

IMPORTANT: PLEASE READ THIS END USER LICENSE AGREEMENT CAREFULLY BEFORE USING THIS APPLICATION.

This End User License Agreement ("Agreement") is a legal agreement between you ("You" or "User") and EHM Tech LLC ("Company", "we", "us", or "our") for the Age Calculator - Birthdays44 mobile application ("Application" or "App").

By downloading, installing, or using this Application, you acknowledge that you have read, understood, and agree to be bound by the terms of this Agreement. You can review the most current version of this Agreement at https://www.ehm-tech.com/age-calculator/eula/.

1. LICENSE GRANT

Subject to your compliance with this Agreement, EHM Tech LLC grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Application for your personal, non-commercial purposes strictly in accordance with this Agreement.

2. LICENSE RESTRICTIONS

You agree NOT to:

  • Distribute or make the Application available over a network where it could be used by multiple devices at the same time
  • Copy, modify, or create derivative works of the Application
  • Reverse engineer, disassemble, decompile, decode, or otherwise attempt to derive or gain access to the source code of the Application
  • Remove, disable, circumvent, or otherwise create or implement any workaround to any copy protection, rights management, or security features in the Application
  • Use the Application in violation of any applicable laws or regulations
  • Use the Application for any commercial purposes without our prior written consent
  • Rent, lease, lend, sell, redistribute, or sublicense the Application

3. OWNERSHIP

The Application is licensed, not sold. EHM Tech LLC retains ownership of all copies of the Application and reserves all rights not expressly granted to you in this Agreement. The Application is protected by copyright, trademark, and other intellectual property laws.

4. AGE CALCULATIONS DISCLAIMER

THE APPLICATION IS PROVIDED FOR PERSONAL AND INFORMATIONAL PURPOSES ONLY. IT IS NOT A SUBSTITUTE FOR OFFICIAL VITAL RECORDS, LEGAL AGE VERIFICATION, OR GOVERNMENT DOCUMENTATION.

The age calculations, birthday countdowns, date information, and related features provided by this Application:

  • Are for personal reference and informational purposes only
  • Should not be relied upon as official proof of age or date of birth
  • Do not constitute legal age verification for any purpose
  • May not account for all calendar systems or regional date conventions
  • Are your responsibility to verify for accuracy

Always use official government-issued documents for legal age verification, identity confirmation, or vital records purposes.

5. SUBSCRIPTION TERMS

The Application offers optional auto-renewable subscriptions that unlock additional features. The available subscription durations and pricing in your local currency are displayed in the Application before you confirm a purchase. By purchasing a subscription, you agree that:

  • Payment will be charged to your Apple ID or Google Play account at confirmation of purchase.
  • Subscriptions renew automatically at the stated cadence and price unless you cancel at least 24 hours before the end of the current billing period.
  • Your account will be charged for renewal within 24 hours prior to the end of the current period, and the renewal cost will be identified by the respective app store.
  • If a free trial or introductory offer is provided, it will automatically convert to a paid subscription at the then-current price unless you cancel before the trial period ends.
  • Any unused portion of a free trial period is forfeited when you purchase a subscription.
  • You can manage or cancel subscriptions at any time using your device account settings: on iOS by visiting Settings > [your name] > Subscriptions, and on Android by opening the Google Play Store and navigating to Profile icon > Payments & subscriptions.
  • EHM Tech LLC is responsible for the Application, its content, and customer support. Refunds and billing disputes are handled by Apple or Google in accordance with their store policies, and we cannot issue refunds directly for purchases made through those stores.

We will notify you of any subscription price changes in accordance with Apple App Store and Google Play requirements, and continued use after the effective date constitutes acceptance of the updated pricing.

6. PRIVACY AND THIRD-PARTY SERVICES

The Application uses third-party services to provide analytics and purchase management. For complete information about data collection, usage, and your privacy rights, please review our Privacy Policy at https://www.ehm-tech.com/age-calculator/privacy/.

Your use of the Application may be subject to the terms and conditions and privacy policies of third-party service providers.

Additional Apple App Store Terms. If you download the Application from the Apple App Store, you acknowledge and agree that: (a) this Agreement is concluded solely between you and EHM Tech LLC, and not with Apple Inc.; (b) EHM Tech LLC, not Apple, is responsible for the Application and its content; (c) Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the Application; (d) to the maximum extent permitted by applicable law, Apple has no warranty obligation whatsoever with respect to the Application, and any claims, losses, liabilities, damages, costs, or expenses attributable to any failure of the Application to conform to any warranty are the sole responsibility of EHM Tech LLC; (e) Apple is not responsible for addressing any claims relating to the Application or your possession or use of the Application, including product liability claims, claims that the Application fails to conform to any applicable legal or regulatory requirement, or claims arising under consumer protection, privacy, or similar legislation; (f) you represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties; and (g) Apple and its subsidiaries are third-party beneficiaries of this Agreement and, upon your acceptance of the terms and conditions of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary.

7. WARRANTY DISCLAIMER

THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EHM TECH LLC DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • TITLE AND NON-INFRINGEMENT
  • ACCURACY OR COMPLETENESS OF CALCULATIONS

You assume the entire risk as to the quality and performance of the Application. Should the Application prove defective, you assume the entire cost of all necessary servicing, repair, or correction.

8. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL EHM TECH LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Any loss of profits, data, use, goodwill, or other intangible losses
  • Any damages resulting from your use or inability to use the Application
  • Any damages resulting from errors, mistakes, omissions, inaccuracies, or defects in the Application
  • Any damages resulting from unauthorized access to or alteration of your data

IN NO EVENT SHALL EHM TECH LLC'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT OF FIFTY U.S. DOLLARS ($50.00).

Nothing in this Agreement excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law. Your statutory rights are not affected.

9. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless EHM Tech LLC and its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney's fees) arising from:

  • Your use of the Application
  • Your violation of this Agreement
  • Your violation of any rights of any third party

10. TERMINATION

This Agreement is effective until terminated. Your rights under this Agreement will terminate automatically without notice if you fail to comply with any of its terms.

Upon termination:

  • You must cease all use of the Application
  • You must delete all copies of the Application from your devices
  • All provisions of this Agreement which by their nature should survive termination shall survive

11. EXPORT RESTRICTIONS

You acknowledge that the Application may be subject to U.S. export control laws and regulations. You agree to comply with all applicable export and import laws and regulations and will not export, re-export, or transfer the Application except as authorized by United States law and the laws of the jurisdiction in which the Application was obtained.

12. U.S. GOVERNMENT RESTRICTED RIGHTS

If you are a U.S. Government end user, the Application is a "Commercial Item" as that term is defined at 48 C.F.R. §2.101, consisting of "Commercial Computer Software" and "Commercial Computer Software Documentation," and is being licensed to U.S. Government end users only as Commercial Items with only those rights as are granted to all other end users pursuant to this Agreement.

13. UPDATES AND MODIFICATIONS

EHM Tech LLC may from time to time develop patches, bug fixes, updates, upgrades, and other modifications to the Application ("Updates"). Updates may be automatically installed without providing any additional notice or receiving any additional consent. You consent to such automatic Updates. You acknowledge that this Agreement will apply to all Updates.

We reserve the right to modify this Agreement at any time. We will notify you of any material changes by posting the new Agreement within the Application. Your continued use of the Application after such modifications constitutes your acceptance of the updated Agreement.

14. SEVERABILITY

If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect, and the invalid or unenforceable provision shall be deemed modified so that it is valid and enforceable to the maximum extent permitted by law.

15. ENTIRE AGREEMENT

This Agreement constitutes the entire agreement between you and EHM Tech LLC regarding the Application and supersedes all prior or contemporaneous understandings and agreements, whether written or oral, regarding the Application.

16. GOVERNING LAW AND DISPUTES

This Agreement shall be governed by and construed in accordance with the laws of the State of Ohio, United States, without regard to its conflict of law provisions.

Any dispute arising out of or relating to this Agreement or the Application shall be resolved exclusively in the state or federal courts located in Ohio, and you consent to the personal jurisdiction and venue of such courts.

17. NO WAIVER

The failure of EHM Tech LLC to enforce any right or provision of this Agreement will not be deemed a waiver of such right or provision.
